DMCA / Copyright Infringement Policy

Fightplane ("Company") respects the intellectual property rights of others and expects Users of http://fightplane.com (the "Site") to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

1. Designated DMCA Agent

Notices of claimed infringement should be sent to our Designated Agent:

2. Filing a Takedown Notice

If you believe a Map or other content on the Site infringes your copyright, submit a written notice to our Designated Agent containing:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to be infringed (or a representative list, if multiple works are covered by one notice);
  3. Identification of the material you claim is infringing, with enough detail (e.g., a URL) that we can locate it on the Site;
  4. Your contact information, including address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Notices missing required elements may not receive a response or may require follow-up before we can act.

3. Our Response to a Valid Notice

Upon receiving a compliant notice, we will:

If you are a Seller and believe your Map was removed or disabled by mistake or misidentification, you may submit a counter-notice to our Designated Agent containing:

  1. Your physical or electronic signature;
  2. Identification of the material removed and its location on the Site before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which the Company may be found), and that you will accept service of process from the person who filed the original notice or their agent.

Upon receiving a valid counter-notice, we will forward it to the original complaining party. If that party does not notify us within 10–14 business days that they have filed a court action seeking to restrain the Seller from the infringing activity, we may reinstate the material.

5. Repeat Infringer Policy

We will terminate, in appropriate circumstances, the accounts of Users who are determined to be repeat infringers. What constitutes a "repeat infringer" is determined at our discretion and may include Users who receive 3 valid, unrebutted infringement notices within 12 months.

6. Misrepresentation

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that it was removed or disabled by mistake, may be liable for damages, including costs and attorneys' fees.

7. Non-U.S. Copyright Complaints

If your content is not protected by U.S. copyright law, or you are located outside the U.S., you may still report infringing content by contacting support@fightplane.com; we will evaluate the report under this policy and applicable law on a case-by-case basis.

8. Changes to This Policy

We may update this policy from time to time. Changes will be posted here with an updated "Last Updated" date.
